INTRODUCTION
The present general conditions apply to the reservations of the restaurant of Las Dalias processed through the website http://lasdalias.es. (hereinafter the "Website"). The formalized reservations constitute a contract between you (hereinafter the Customer) and the company whose fiscal data are indicated below (hereinafter the RESTAURANT):

The request and processing of reservations on this website implies full and unconditional acceptance of the Legal Notice and Privacy Policy of the Web along with these general conditions of contract, in its latest version, without prejudice to the particular conditions of the reservations that are available in the process. Therefore, we advise you to read these conditions before requesting or formalizing your reservation and each time you access our website, as we reserve the right to change, modify, add or delete at any time part of these general conditions.

LEGAL REGULATION
These general conditions are subject to the provisions of Law 7/1998 of 13 April on General Contracting Conditions, Royal Legislative Decree 1/2007 of 16 November, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce, as well as all applicable tourism regulations and, subsidiarily, the Civil Code and the Commercial Code.

CLAUSE
The formalization of reservations through the Web is subject to the following clauses:
1. Manifestations: The Client declares:
a) To be of legal age and have full capacity to formalize the reservation, stating that he/she understands and understands all the conditions found on the Web.
b) That the information provided when making the reservation is true and complete.
c) That he/she confirms the reservation requested and especially the dates indicated and the number of people.

2. Access to the Web: Access to this website is the responsibility of the Client.

3. Reservation:
3.1. The reservation includes the services detailed according to the conditions stipulated on the page from which it is requested or formalized. These particular conditions together with the present general conditions must be accepted by you before formalizing the booking.
3.2. The reservation may be validly formalized in Spanish and in the other languages available on the web. In case of discrepancy between the translated versions of these conditions, the Spanish version shall prevail.
3.3. On-line reservations: The process of formalizing on-line reservations follows the following steps:
1. Availability: Search for dates and selection of the number of persons.
Collection of personal data and acceptance of these general conditions.
3. Request of credit card data as a guarantee.
4. Confirmation of the reservation, error or cancellation of the same.
Once the reservation has been made, the Client will receive a "Reservation Confirmation" by SMS to the cell phone number provided. If you do not receive the reservation confirmation or if any information in the confirmation is incorrect, please contact the restaurant.
3.4. At each step of the booking process, any errors in data entry can be corrected by using the "back" button on your browser. Likewise, the Reservation Confirmation will recapitulate the reservation data. If any errors are detected, Customers should immediately request corrections by sending an email to: hola@lasdaliasibiza.com.

4. Modification, no show or cancellation of reservations:
4.1. Any modification or cancellation must be requested to the RESTAURANT by telephone, at the e-mail address available on the Website or in the Reservation Confirmation.
4.2. The modification of the reservation is subject to availability at the RESTAURANT.
4.2. In case of no-show or cancellation of your reservation within 12 hours of the arrival time, a charge of 20 euros per diner will be made to the card provided as a guarantee. In application of the European directive 2015/2366 of Payment Services (PSD2), the charge on your card will be conditioned to a double authentication by the customer.

5. Right of withdrawal: For the purposes of the provisions of Article 97.1.m) RDL 1/2007, you are informed that, in accordance with the provisions of Article 103 l) of the aforementioned Royal Decree Law, you do not have the right of withdrawal.

6. Nullity of the clauses: If one or more of the clauses included in these general conditions is declared totally or partially null or ineffective, this will affect only that provision or that part that has been so declared, the general conditions remaining in all other respects, and such provision, or the part of the same affected, will be considered as not being in force.

7. Acceptance: The request and the formalization of the reservation necessarily imply that each and every one of these general conditions, considered as an integral part of the reservation and completed with the tariff conditions and the specific applicable legislation, are expressly accepted by you. The present conditions, the particular conditions of the rate and the confirmation or reservation request, express the entirety of the obligations between the parties.

8. Applicable law and jurisdiction: This contract shall be governed by Spanish law excluding its conflict of law rules. Without prejudice to the rights recognized to consumers in matters of jurisdictional competence by Royal Legislative Decree 1/2007, of 16 November, any dispute that may arise from the use of the Web or of the services linked to the same will be subject to the jurisdiction and competence of the competent Courts and Tribunals in accordance with the domicile of the RESTAURANT, the Client expressly waiving its own jurisdiction if it has one.
