PRIVACY POLICY - USE OF IMAGES

Please read this privacy policy carefully. In it you will find important information about the processing of your personal data and your rights under current legislation on the subject.

We reserve the right to update our privacy policy at any time due to business decisions, as well as to comply with possible legislative or jurisprudential changes. If you have any questions or need any clarification regarding this Privacy Policy or your rights, you can contact us through the channels indicated below.

Who is responsible for the processing of your data?

The data controller is LA SALA DALIAS, S.L. (LA SALA DALIAS, hereinafter) with address at Ctra. San Carlos, KM. 12, 07850 Santa Eulalia des Riu - Ibiza (Illes Balears).

You can contact our Privacy Officer at the address of LA SALA DALIAS or privacy@lasdalias.es.

For what purposes do we process your data and on what legal basis?

The image and / or voice captured on the occasion of videos and photographic reports made by LA SALA DALIAS in events or any activity organized by the responsible or during your visit to our facilities, will be treated for promotional and advertising purposes of the services we offer and activities we develop.

This processing is legitimized on the following legal bases:

- In videos and photographic reports in which a specific person or group of persons is approached, the legal basis for the processing is their consent, expressed in writing or by intentionally posing in front of the camera. If the data subjects are minors, the processing will be authorized by the person holding parental authority or guardianship of the minor or by a third party authorized by them to give consent on their behalf. You can revoke your consent by contacting us at privacy@lasdalias.es.

- In the case of videos and photographic reports that capture general or ambient shots, in which the image of people appears as merely incidental, the legal basis for processing is the legitimate interest of LA SALA DALIAS in informing the general public of events and events that we organize. For the weighting of this interest with respect to the freedoms and rights of data subjects, the following was determined:

o The processing is carried out under the protection of Art. 8.2.c) of Organic Law 1/1982, of May 5, 1982, on the civil protection of the right to honor, personal and family privacy and self-image.
o The processing is compatible with the reasonable expectations of the interested parties, as it is a generalized practice in public events and acts.
o The processing is proportional and the intrusion into the privacy of the data subjects was limited, as no images of a person or group of persons that stand out from others were captured, as measures were adopted to minimize the identification of the data subjects and so that, in short, their image appears as merely incidental. In addition, if minors appear in the images or videos, measures should be adopted to prevent their identification.

To whom can we communicate your data?

The material resulting from the videos and photographic reports will be disseminated to the general public, mainly, but not limited to, through the profiles of LAS DALIAS on social networks, its websites, magazines, reports, newsletters, yearbooks or through any media.

How long will we keep your data?

Your data will become part of the image archive of LAS DALIAS and will be retained as long as THE DALIAS ROOM deems necessary for the proper achievement of the purposes described above, and under the provisions of the General Data Protection Regulation and the Spanish O.L. 1/1982, on Civil Protection of the Right to Honor, Personal and Family Privacy and Self-Image.

What are your rights?

You have the right to obtain confirmation as to whether or not we are processing your personal data and, if so, to access it. You can also ask for your data to be rectified if it is inaccurate or for incomplete data to be completed, as well as request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

In certain circumstances, you may request that we restrict the processing of your data. In such a case, we will only process the data concerned for the formulation, exercise or defense of claims or for the protection of the rights of other persons.

Under certain conditions and for reasons relating to your particular situation, you may also object to the processing of your data. In this case, we will stop processing the data, except for compelling legitimate reasons that override your interests, rights and freedoms, or for the formulation, exercise or defense of claims.

However, you may revoke your consent at any time. We will then stop processing your personal information for these purposes. Withdrawal of consent does not affect the lawfulness of the processing carried out prior to such withdrawal.

You may also, under certain conditions, request the portability of your data to be transferred to another data controller.

You also have the right to file a complaint with the Spanish Data Protection Agency or any other competent supervisory authority.

To exercise your rights, you must send us a request accompanied by a copy of your national identity card or other valid document that identifies you by post or e-mail to the addresses indicated in the section Who is the data controller?

You can obtain more information about your rights and how to exercise them on the website of the Spanish Data Protection Agency at www.aepd.es.
